Purpose:

We, the undersigned homeowners of Riverside Community Association, respectfully petition the Board of Directors to call a Special Meeting under N.C.G.S. § 47F-3-108 and Article III, Section 3.3 of the Riverside Bylaws. This petition is submitted in light of serious concerns regarding HOA governance, financial risk exposure, and inconsistent enforcement affecting all residents. Agenda items for the requested meeting: 1. Vote of No Confidence and Removal of HOA President (Steve Lima) Mr. Lima received Board-approved financial relief for his own delinquent dues, while others in arrears faced full enforcement. This constitutes unequal treatment and raises ethical concerns about misuse of authority. 2. Engagement of Independent CPA for Audit Over $40,000 in unexplained monthly expenditures have been carried forward for more than five months. No vote, breakdown, or plan has been provided. This lack of transparency endangers lending eligibility and homeowner equity. 3. Review of the $19,000 Speed Bump Contract Mr. Lima signed a vendor contract on April 8, 2025, after a contested special assessment and without a recorded Board vote. The contract includes a 25% cancellation fee regardless of service delivery. This exceeds the authority of any single officer and puts homeowners at financial risk. We request that the above matters be addressed transparently and without delay, and that a Special Meeting be scheduled in accordance with North Carolina law and the Riverside governing documents.

This petition is created under the authority of N.C.G.S. §47F-3-108, which allows members holding at least 10% of votes to demand a special meeting, and N.C.G.S. §47F-3-103, governing special meeting procedures.
