Purpose:

Riverside HOA: Petition for Leadership Accountability, Financial Transparency, and Immediate Governance Review We, the undersigned homeowners of Riverside Community Association, respectfully petition the Board of Directors to call a Special Meeting under N.C.G.S. § 47F-3-108 and Article III, Section 3.3 of the Riverside Bylaws. This petition arises from material concerns over HOA governance, financial risk exposure, and inconsistent enforcement that affect our entire community. Our petition seeks the following agenda items to be addressed transparently, without delay or obstruction: 1️⃣ Removal of the current HOA President (Steve Lima) - We call for a formal vote of no confidence and the removal of the current HOA President for the following reasons: - Emails confirm that Mr. Lima received internal Board-approved financial relief for his own delinquent HOA dues, while other residents in arrears were subjected to full enforcement. - This raises serious ethical and fiduciary concerns, undermining equal treatment and governance integrity. 2️⃣ Formal engagement of a licensed third-party CPA for independent audit - The HOA has carried forward over $40,000 in undefined expenditures monthly for over five consecutive months with no explanation, no vote, and no itemized plan. - This obscures fiscal accountability and may put the community at risk with mortgage and lending thresholds (e.g., FHA standards). 3️⃣ Full review of the unilaterally executed $19,000 speed bump contract - Mr. Lima signed a vendor contract on April 8, 2025—after the special assessment was formally contested and without a documented Board vote. - The contract includes a 25% cancellation fee clause that financially obligates the Association even if no work is performed. - This action exceeds the scope of authority of a single officer and exposes homeowners to undue risk. 📌 Conclusion The above issues collectively demonstrate: - Procedural bypass, - Misuse of authority, - Lack of transparency, and - Unequal treatment of homeowners. We therefore request a Special Meeting to be called in compliance with the North Carolina Planned Community Act and Riverside’s governing documents. Failure to acknowledge and act on this petition may constitute a breach of fiduciary duty and further erode community trust.
